Roma Hukuku, Kara Avrupası hukuku sisteminin temelini oluşturmaktadır. Özellikle Roma Hukukunun temel hukuk ilkeleri, hukuksal düşünce tarzı ve eğitim metodolojisi, halen günümüzdeki hukuku derinden etkilemektedir. Bu etkileme, tarihsel ve amaca göre yorum yanında hukuksal değere göre yorum bakımından da karşılaştırmalı hukuka hizmet etmektedir. Bu kitapta Roma Hukukunun güncel hukuka etkisi çeşitli açılardan ve farklı ülkelerdeki yetkin hukukçularının bakış açılarıyla incelenmiştir. Özellikle hukuka başlangıç ve borçlar hukuku dersleri başta olmak üzere günümüz hukukunun daha iyi anlaşılması ve mevcut pozitif normların çağdaş yorumlanabilmesi için, Roma Hukukunda ki esaslara temel ilkeleri düşünce kalıplarına bakılmalıdır. Kitaptan "güncellik" konusu bağlamında mala karşı suçlar ve şerefe karşı suçlar yanında, bu suçların haksız fiil bağlamındaki izdüşümleri de incelenmiştir. Kitap içeriğinde çok farklı ülkelerdeki roma hukukçularının hem kendi kişisel görüşleri hem de roma hukuku tarihine ilişkin esaslı incelemeleri yer almaktadır. Günümüz hukukçuların güncel hukuku daha iyi anlamaları ve geliştirmeleri için bu kitap önemli bir kaynak oluşturacaktır. Kitap ayrıca, içerdiği konular itibariyle lisansüstü çalışmalar için de önemli bir kaynak niteliğindedir. Roma hukukunun günümüz hukukunda da yararlanılması kaçınılmaz rolünü oynaması, çağdaş roma hukukçularının güncel çalışmalarını karşılaştırmalı hukuk bağlamında incelemek ve ulaşılan verileri ulusal hukuka aktarmakla olur. Kitap, özellikle yabancı dil(ler)e hakim lisans öğrencilerine tavsiye olunur. |
